Acknowledgement of Risk and Waiver of Liability
Thank you for registering for the yoga and dance retreat at Hacienda de San Rafael to be held from July 11-16 2023 (the “Retreat) and organized by Tootsie Olan and Tootsie Olan Productions LLC (collectively, the “Retreat Organizer”). You hereby agree as follows:
Registration Details. Your registration fee includes the cost of accommodations at Hacienda de San Rafael, a daily light breakfast, lunch, and dinner, daily yoga, meditation and dance classes in specified areas in and near the hotel. The cost of all alcoholic beverages shall be your responsibility.
Travel Arrangements. All travel arrangements to and from Hacienda de San Rafael and all transportation costs while on the Retreat are at your own cost and expense. You expressly waive any right to hold the Retreat Organizer liable for (a) any changes or delays in travel schedules or additional expenses related thereto, (b) any injury, loss or damage to persons or property, including luggage, while on the Retreat or during travel to and from Hacienda de San Rafael and (c) any other losses, damages or expenses arising out of transportation to, from or during the Retreat.
Travel Insurance. All participants in the Retreat are strongly advised to get travel, medical, accident, cancellation and baggage insurance or whichever is appropriate for the mode of travel to retreat (e.g. flight, car, transfers). The Retreat Organizer carries no insurance whatsoever for Retreat participants. Retreat participants should bring copies of their policies with them in case of an emergency.
Publication Release. The Retreat Organizer or its representatives may photograph, audio record and/or video record activities that take place during the retreat. The Retreat Organizer reserves the right to publish any such photographs, audio recordings and video recordings without obtaining further consent from any participant. Each participant releases the Retreat Organizer and its representatives from any liability in connection with any such use of such photographs, audio recordings or video recordings.
General Waiver of Liability. The Retreat Organizer is making certain limited arrangements related to hotel accommodations, meals and yoga and dance classes during the Retreat. Notwithstanding such arrangements, the Retreat Organizer takes no responsibility or liability for, and you expressly waive any right to hold Retreat Organizer liable for, any injury, illness, death, theft, or damage, however or wherever caused, arising out of or occurring during the Retreat.
Waiver of Liability for Yoga and Dance Classes. You hereby acknowledge that the dance and yoga classes to be led by the Retreat Organizer during the Retreat will involve rigorous physical activity, and that the Retreat Organizer will not in any way attempt to confirm your state of health or physical condition. You further acknowledge that participation in such dance and yoga classes include the risk of injury and physical distress. It is your responsibility to consult with a physician prior to and in reference to your participation in such classes. You hereby represent and warrant that you are physically fit and have no medical condition that would prevent your full participation in dance and yoga classes. You expressly waive and release the Retreat Organizer from any and all manner of liabilities, claims and demands of any kind or nature, including liabilities, claims or demands arising out of personal injuries or damages sustained, incurred or otherwise as a result of participation in dance and yoga classes held during the Retreat.
Refunds and Cancellations. All registration fees are non-refundable. There will be no refund for any cancellations prior to the Retreat, or for any participant who leaves the Retreat prior to its conclusion, for whatever reason. Notwithstanding the foregoing, in the event of a cancellation prior to the start of the retreat, the Retreat Organizer may, in its sole discretion, offer a complete or partial refund if another person can be found to take your place.
COVID Release. Because the Retreat gathers people together, you recognize that you may be at higher risk of contracting COVID-19 due to your participation in the Retreat. With full awareness and appreciation of the risks involved, you expressly waive and discharge the Retreat Organizers from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by you during or after the Retreat that is related to COVID-19, whether caused by the negligence of the Retreat Organizers, any third-party or otherwise.
THIS IS A LEGALLY BINDING AGREEMENT. BY SIGNING THIS DOCUMENT, YOU ARE WAIVING CERTAIN RIGHTS, INCLUDING THE RIGHT TO BRING A LAWSUIT TO RECOVER DAMAGES IF YOU ARE INJURED WHILE PARTICIPATING IN THE RETREAT. PLEASE READ CAREFULLY BEFORE SIGNING.
